Acceptance of Terms
By accessing or using the PezeA website, app, and services (the “Platform”), the user agrees to these Terms and all policies referenced herein (Privacy Policy, Shipping & Delivery Policy, Cancellation & Refund Policy). If the user does not agree, the user must not use the Platform. -
Eligibility and Account

Users must be at least 18 years old and legally capable of entering into binding contracts under applicable law.

Users are responsible for maintaining the confidentiality of login credentials and all activities under their account.

PezeA may suspend or terminate access for suspected fraud, abuse, policy breaches, or security risks.

Platform Role and Marketplace Model

PezeA facilitates orders between users and independent restaurants/partners and may coordinate delivery through delivery partners; restaurants are responsible for food preparation, quality, and compliance.

Menus, prices, taxes, packaging charges, and availability are set by restaurants and may change.

Ordering and Acceptance

Placing an order constitutes an offer by the user. Restaurant acceptance and/or delivery assignment constitutes Order Acceptance.

Post‑acceptance, cancellations, fees, and refunds are governed by the Cancellation & Refund Policy.

If items are unavailable, PezeA may offer substitutions/partial fulfillment or cancel with a refund per policy.

Prices, Fees, and Payments

The checkout screen shows item prices, taxes, packaging, delivery, surge, and other fees; the total payable appears before payment.

Payments may be processed by PezeA or authorized payment providers. If an accepted order becomes unserviceable, refunds are processed per policy.

Delivery and Proof of Delivery

Delivery depends on serviceability, partner availability, and external conditions; ETAs are estimates.

Delivery proof may include OTP verification, photos, timestamps, GPS logs, and call/message attempts.

Unsuccessful deliveries due to address/access/unavailability issues may incur charges per policies.

Cancellations, Refunds, and Support

Rules for customer cancellations, platform/restaurant cancellations, fees, and refund timelines are set out in the Cancellation & Refund Policy.

Quality/safety concerns should be reported within 24 hours of delivery with photos and details via in‑app Help/Support.

Restaurant/Partner Responsibilities

Partners must hold required licenses/registrations and comply with applicable food safety and consumer laws.

Partners authorize listing, promotions, order processing, and payment collection/settlement as agreed separately.

User Conduct
-
Prohibited: fraud, chargeback abuse, reselling, harassment, platform interference, scraping, reverse engineering, unlawful or harmful content/behavior.

PezeA may cancel orders, deny refunds, recover fees, or suspend/terminate accounts for violations.

Intellectual Property
-
The Platform, content, trademarks, and software are owned by or licensed to OmniFlare Nexus/PezeA.

Users receive a limited, revocable, non‑transferable license to use the Platform for personal, lawful purposes.

Privacy and Security
-
Personal data is handled per the Privacy Policy. Security safeguards are implemented; however, no system is entirely risk‑free.

OTP/device permissions may be used for verification, fraud prevention, and delivery completion.

Marketing, Promotions, and Data Sharing

With explicit, unambiguous opt‑in consent, PezeA may use personal data (e.g., name, contact, device identifiers, engagement/transaction signals) to personalize offers, send promotional communications, and measure campaigns.

With consent, PezeA may share personal data with (i) service providers (SMS/email, analytics, ad platforms) under contracts and (ii) in‑house/group entities for cross‑promotions. These parties must follow instructions and protect data.

Users can withdraw marketing consent or opt out at any time via in‑app settings or unsubscribe links; core services remain unaffected.

Separate, granular preference controls (e.g., email, SMS/WhatsApp, third‑party ad personalization) are provided.

Third‑Party Services

Payment gateways, maps, communications, and analytics are provided by third parties; their terms may apply. PezeA is not liable for outages beyond reasonable control.

Warranties and Disclaimers

Services are provided “as is” and “as available.” PezeA disclaims implied warranties to the extent permitted by law.

Food is prepared by independent restaurants; remedies are as per policies and applicable law.

Limitation of Liability

To the maximum extent permitted, PezeA/OmniFlare Nexus are not liable for indirect, incidental, or consequential damages. Total liability for a claim is limited to the amount paid for the affected order.

Indemnity

Users agree to indemnify and hold harmless PezeA/OmniFlare Nexus and affiliates from claims arising from violations of these Terms, unlawful acts, or rights infringements.

Suspension and Termination

PezeA may suspend/terminate access or remove content/listings for policy violations, fraud, or risk. Users may close accounts when eligible orders/refunds are settled.

Governing Law and Dispute Resolution

These Terms are governed by Indian law. Disputes are subject to the exclusive jurisdiction of competent courts at the company’s registered jurisdiction. Parties shall first attempt good‑faith resolution, followed by mediation/arbitration where feasible.

Changes to Terms

PezeA may update these Terms. The latest version on the Platform applies upon publication. Continued use constitutes acceptance.
